Photo by John Locher.]]] Friends and state officials gathered Saturday for the funeral of state Controller Kathy Augustine. Noticeably absent from the crowd of about 200 mourners at the Guardian Angel Cathedral, however, was Augustine's husband, Chaz Higgs. Higgs, 42, was released from University Medical Center Friday evening after slitting his wrists earlier in the day in what police said was an attempted suicide at the couple's Las Vegas home. It was unknown whether Higgs attended Augustine's burial, which was closed to the public. Those present at the funeral service Saturday were quick to praise Augustine but reluctant to comment on the events that have transpired since her unexpected death. "I never thought in a hundred years I'd be here standing before you for the funeral of Kathy Augustine," the Rev. Mike Keliher of St. Viator Catholic Church told the audience. "The sudden and unexpected death of Kathy Augustine confronts us all," he said, during the brief, traditional Catholic service at the cathedral near Las Vegas Boulevard and Desert Inn Road. No family spoke during the service. Augustine died Tuesday at Washoe Medical Center, three days after Higgs said he found her unconscious in their Reno home. Higgs, a critical care nurse, said the 50-year-old Augustine died of an apparent heart attack. The Washoe County coroner's office has yet to release final autopsy results, but Reno police Deputy Chief Jim Johns said Friday that preliminary indications were "there wasn't evidence of long-term heart disease." Reno police, the state Division of Investigation and Las Vegas police are investigating her death. Augustine, a former assemblywoman, was running for state treasurer because she was term-limited out of office. In 2004, the state Assembly impeached her on three counts of campaign violations, but she was not removed from office. Elected officials in attendance Saturday included Rep. Shelley Berkley, D-Nev., Gov. Kenny Guinn and Secretary of State Dean Heller. Guinn said Saturday he was surprised at Augustine's death. He said she always tried to stay in good physical shape. As for Higgs' possible suicide attempt, Guinn said, "You never know what goes through another person's mind." Guinn said he wanted to see how the investigation plays out before commenting. Former Lt. Gov. Lonnie Hammargren said after the service, "I've got two words (to describe) Kathy: spunky and she was feisty. I even still consider voting for her." Hammargren, a retired neurosurgeon, said he felt Higgs was grieving and not suicidal when Higgs slit his wrists. "Nurses know you can't kill yourself by slashing your wrists," he said. Most people remembered Augustine as an outgoing, strong-willed woman who loved politics. "That's what I will remember is her laugh," Heller said. Photo by John Locher.]]] Taking the stage after a nine-piece lounge band's set, backed by a twinkling curtain of artificial stars, Rep. Shelley Berkley launched her re-election bid Wednesday night. Berkley, a Democrat, filed her paperwork for candidacy nearly two months ago but didn't officially kick off her campaign until Wednesday's festive event at North Las Vegas' Cannery hotel-casino. Advertisement Speaking briefly to the crowd of stalwart supporters, Berkley predicted Democratic success in November's midterm elections. "This is going to be a wonderful year," she said. "I think we have a very good chance of bringing some balance back to the U.S. government." Berkley faces one other Democrat, the unknown Asimo Sondra "Silver" Lawlor, in the Aug. 15 primary. A victory there will pit her in November against the winner of the three-way Republican primary as well as a Libertarian, an Independent American and a member of the Reform Party. Berkley is seen as a nearly unbeatable favorite to win a fifth term representing Nevada's first congressional district, which encompasses most urban areas of Clark County. The district is overwhelmingly Democratic, with 37,000 more registered Democrats than registered Republicans. The 55-year-old congresswoman, nearly as renowned for her flamboyant personal style -- she has discussed her cosmetic surgery publicly -- as for her liberal views, said she was optimistic about her campaign. "This community has been very supportive of my service in Washington," Berkley said. "They're happy with me." She cited her work to bring a veterans' hospital to Southern Nevada and federal dollars for transportation projects as accomplishments of her recent term, as well as her continuing fight against Yucca Mountain and her expertise in Middle East affairs. Asked what voters could expect from another Berkley term, she said, "More of the same," adding, "There isn't anybody who fights harder for her community than I do." Berkley said she believes Democrats can take back control of the U.S. House of Representatives, which has had a Republican majority since 1994. National political commentators say a Democratic takeover will be difficult but not impossible if the party succeeds in capitalizing on disenchantment with the Republican Party. The Democrats need to win 15 more seats in the 435-person body to earn a majority. She said people will vote for Democratic candidates because the Republicans have let them down. "Do Americans feel more secure than they did four years ago?" she said. "I do not feel more secure. Veterans living in Las Vegas know first hand that health care services are already stretched to the limit and reducing the amount of money available for the VA will only make a bad situation worse," said Berkley _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ __ _ _ _ _ _ _ _ _ The Republican Lead Congress Fails to Protect Our Nations Seniors Against Medicare Rx Penalties Congress adjourned for the Memorial Day break without extending the current May 15 deadline for seniors to join a Medicare prescription drug plan. Those who enroll after May 15 face permanent penalties resulting in a lifetime of higher payments for coverage. "Because Congressional Republicans failed to act this week, many Nevada seniors will pay more for their medicines as a result of these lifelong penalties," said Berkley. "We should be helping our seniors, not punishing them for taking the time to choose a plan that is both affordable and right for their needs. While insurers and pharmaceutical companies will reap the financial benefits of this GOP-authored provision, it is seniors in Las Vegas and across our nation who will literally pay the price,"said Berkley. Seniors who missed the May 15th deadline to enroll can still take part in the program, but they cannot do so until November 15, 2006 and their coverage will not begin until January 2007. In addition, they will be assessed a 1% increase for each month they delay, meaning seniors who enroll in December will pay 7% more for their plan. Seniors will be forced to pay these penalties for the rest of their lives. "Not only will older Nevadans be hit with a Republican penalty tax, they will also be blocked from receiving any help with their drug costs until January of next year. This is a bad law, and it needs to be changed so that seniors in Southern Nevada and across the U.S. are protected against financial penalties that will make the cost of their medicines even more expensive for the rest of their lives," said Berkley, who voted against the Republican-authored Medicare prescription drug law in 2003. Berkley is a cosponsor of The Medicare Informed Choice Act, which would protect older Americans against the harsh financial penalties included in the Medicare prescription drug law. This legislation allows for continuous open enrollment for 2006 and would delay any late enrollment penalties until 2007. Berkley Grills DTRA Head Over Safety Precautions For 700 Ton Bomb Blast At Nevada(Washington, DC -- April 6, 2006) Congresswoman Shelley Berkley (D-NV) met today in her Washington office with Dr. James Tegnelia, Director of the Defense Threat Reduction Agency (DTRA) to discuss safety issues regarding the planned detonation of a 700 ton bomb at the Nevada Test Site. Berkley also received an apology on behalf of Nevadans from Tegnelia for his recent statements about a mushroom cloud being visible over Las Vegas for the first time since the end of nuclear weapons testing.*1 While I am glad Dr. Tegnelia took this opportunity to apologize for causing alarm with his mushroom cloud comment, the real purpose of this meeting was to ensure that every precaution has been taken and that there is no safety threat to Southern Nevada residents, said Berkley. I grilled Dr. Tegnelia about why this test was needed and what the impacts would be on the environment, and he personally assured me that the DTRA has looked at the dangers and taken the steps necessary to protect the public, Berkley said. Nevadans have a long and proud history of supporting our nations defense, but we have also been the victims of nuclear testing, and that is why it is my duty not to just accept what I am told, but to ask tough questions on behalf of those I represent in the Las Vegas Valley. I will not seek to block this mammoth explosion, which will create a plume over the Nevada Test Site, but I will keep a close eye on how the public is being prepared and I will demand full answers to any new concerns that may arise. Following questions raised by Berkley regarding planning, notification and outreach surrounding the test, DTRA will be launching an aggressive effort to ensure the public has access to information regarding the blast, including environmental studies, and that the media will be given access to the site prior to the explosion and on the day of the actual test. During the meeting, Berkley was told that the DTRA test was not part of an effort to resume nuclear weapons testing 90 minutes outside Las Vegas, as was alleged this week by the American Federation of Scientists. I have been informed that this detonation is not part of a broader plan to resume nuclear weapons testing in Nevada, which I strongly oppose, said Berkley, who has lived in Las Vegas since the days of above ground nuclear testing. This plan also sends the wrong signal to Iran, and other nations with nuclear ambitions. While the U.S. and its allies are loudly calling for new nuclear power plants to sprout up around the globe, we are busy telling Iran that it is not OK if they pursue the same capability. Clearly, these mixed signals erode our credibility and only embolden those who seek nuclear power as a means to possessing nuclear weapons," said Berkley, who serves as a member of the House International Relations Committee. At S. Nevada's Ground Blessing Ceremony for the new VA Medical Complex: "At a time when we are seeing new veterans from Iraq and Afghanistan returning home, and a continued increase in the number of veterans living in Southern Nevada, we are in desperate need of the facilities to provide these brave men and women with the world-class health care that they have been promised in return for their military service. On the Republican Budget Package: This budget slashes student loans by $12 billion "More than 18,000 Nevada students will now face an average increase of $5,000 or more in their student loan costs as a result of this flawed budget package. As someone who relied on student loans, I know how hard it can be to find the funding to pay for college, and it is shameful that Republicans are out to balance the books on the backs of students and their parents," said Berkley, who is a former Nevada University and Community College System Regent. Lower education will also receive budget cuts. "Even as Nevada struggles to find more classroom resources, this budget package slashes $6.8 million in funding to aid disadvantaged students with reading and math and to fund special education needs. That is in addition to the nearly $2.5 million that will be taken away from Nevada Head Start programs which provide disadvantaged children with a chance at early education," said Berkley. This budget package slashes $44 million in funding for Medicaid, which provides health care to more than 200,000 children, seniors and disabled Nevadans. And for the very first time, states will be free to charge some Medicaid eligible children premiums and co-payments, driving-up health care costs for our neediest families," said Berkley. $1.6 billion will be cut in enforcement spending for Nevada and other states for single parents and families who depend on child support. "These provisions will actually reduce child support collections by $8.4 billion over the next 10 years. Why on Earth would we cut funding that enables Nevada and other states to collect overdue child support from deadbeat parents who refuse to pay what they legally owe?" said Berkley. "Although I supported the disengagement, it broke my heart to witness the dismantling of the settlements and the removal of people who have called the Gaza home for forty years," Berkley said. • Berkley released a statement on the revised EPA radiation standard for Yucca Mountain: "Even though they have proposed a new radiation standard, the Bush Administration has yet to prove that the canisters holding the waste will not corrode and dump this radioactive garbage into our drinking water." • Congresswoman Berkley strongly criticized two party line votes in the House International Relations Committee that blocked separate inquiries into the outing of CIA agent Valerie Plame and the so-called "Downing Street Memo," which accuses the Bush Administration of manipulating the evidence used to justify a military invasion in Iraq. "Deciding this issue on a party-line vote only fuels existing cynicism and leaves a lingering doubt about promises made by the White House to fully cooperate with the investigation into this despicable act," Berkley said. • Berkley hosted a Post-Katrina First Responders Roundtable in Las Vegas POST-KATRINA FIRST RESPONDERS ROUNDTABLE Continuing in her efforts to assess and improve disaster and emergency preparedness in Southern Nevada, Congresswoman Shelley Berkley hosted a closed-door roundtable with more than 45 local first responders, emergency managers and health care providers, on October 11th at the Foley Federal Building downtown. Joining Berkley at the roundtable were representatives from law enforcement (LVMPD, NHP, NLV Police, TSA, FBI); the Nevada National Guard; local firefighters (Clark County, City of Las Vegas); federal, state and local disaster response and homeland security officials (State of Nevada, Clark County, NLV, CLV, DHS); health officials and hospital operators; broadcasters; transportation planning agencies (RTC, DOT); flood control; and community based and charitable organizations that would play a role in emergency response. Berkley voted in early October in favor of legislation that would allocate more federal dollars to communities based on actual threat levels. The spending package also recognizes tourism as a factor in determining how resources are allocated. Berkley Successful In Convincing VA Not To Investigate 72,000 PTSD Claims Clerical Errors, Not Fraud to Blame for Missing Claim Documents(Washington, DC -- November 9, 2005) Congresswoman Shelley Berkley (D-NV) today praised a decision by the Department of Veterans Affairs (VA) not to review the benefits awarded to 72,000 veterans suffering from post-traumatic stress disorder (PTSD).*1 "Scrutinizing more than 72,000 PTSD cases that have already been decided would have been unfair to our veterans, especially in light of the fact that clerical errors, and not fraud, were found to be the cause of concern. I am particularly pleased that this decision was reached as our nation prepares to recognize the service and sacrifice of millions of Americans this Veterans Day. PTSD may not be as visible as other battle wounds, but its impact on those who have been diagnosed, and their loved ones, can be just as painful and as permanent as any physical injury," said Berkley, who serves as the Ranking Democrat on the House Subcommittee on Disability Assistance and Memorial Affairs. The announcement that no review of the veterans' claims would take place was in response to the efforts of Berkley and others on the House Veterans' Affairs Committee who sought to protect those diagnosed with the stress disorder from unwarranted scrutiny of their mental health claims. Berkley noted that during a recent hearing on the issue, the House Committee on Veterans' Affairs heard testimony concerning one New Mexico veteran who had committed suicide after expressing concerns about the proposed VA review and another who was stopped by family members from an attempted suicide. Berkley's effort earned the praise of Veterans Affairs Committee Ranking Democrat Lane Evans (D-IL), who noted the persistent advocacy of two Committee members - Rep. Berkley and Rep. Tom Udall (D- NM) - was instrumental in bringing attention to the risks posed by the proposed review and in bringing about its termination. "Shelley is an outspoken champion for her veterans in Las Vegas and throughout the Nation, and Tom shared with the committee his personal knowledge of the suffering endured by New Mexico veterans whose claims had been subjected to an earlier review and those who feared, even without justification, that their benefits would be taken away," said Evans. According to the VA, On May 19, 2005, the Departments Inspector General reported on an examination of the files of a sample of 2,100 randomly selected veterans with disability ratings for post-traumatic stress disorder (PTSD). The IG cited insufficient documentation in the files and a dramatic increase in veterans filing for disability compensation for post-traumatic stress disorder since 1999.
