Dr. Tony Lei received a letter from District Judge Mark Denton soon after the first edition of this feature article was published. The letter written by him was sent to Dr. Lei by mail from his Department XIII of the Eight Judicial District Court on May 18, 2004.

"Dear Dr. Lei, Thank you so much for including me in last Friday's dinner recognition for Dean Livingstone. It was great to see you and to meet the Dean and the other Pepperdine alumni. Dr. Linda Livingstone, Dean of Pepperdine University's Graziadio School of Business and Management, invited several selected and achieved alumni to dinner with her at the Pietro's Gourmet Restaurant of Tropicana Hotel and Casino in Las Vegas, Nevada on May 14, 2004.

Dr. Tony Tung-tien Lei received MBA with straight A from Pepperdine University in 1969. He received his Doctor of Education degree in Institutional Management from Pepperdine University in 1990. He was an Assoiciate Professor of Information Management of the Graduate School of Business Administration of National Chunghsin University and a Fellow of Management for Dean Dr. Donald R. Sime of the School of Business and Management of Pepperdine University.

Ms. Helen Hsueh and Mr. Robert Song were invited by Dr. Tony Lei as our representative and photographer for the Chinese multimedia. Helen Hsueh is the President of Las Vegas Chinese Daily News, while Robert Song is the President of Pan-America Legal Services Company. "It's good to have more people joining us as friends of our Pepperdine family," said Dean Livingstone at the Dinner Party.

"It was a pleasure having you join us at our dinner. Thanks to for sending the pictures. They are great," wrote Dr. Livingstone to Robert Song, who sent out the pictures to all participants soon after the Dinner.

Recently, the Los Angeles Business Journal ranked and reported that Pepperdine University's Graziadio School of Business and Management was named "the pacesetter" in MBA education in Los Angeles County. The School retained top ranking ahead of USC's Marshall School of Business and The Anderson School at UCLA which placed second and third respectively.

As the market share leader in California, graduates of MBA annually from Graziadio School are more than any other school in the state. It is the sixth largest AACSB-accredited school in the United States. Dr. Livingstone received her B.S., M.B.A., and Ph.D. from Oklahoma State University. She assured her responsibilities as the Dean of the School on June 1, 2002.

She expressed a keen interest in building additional bridges between Pepperdine MBA curriculum and the corporate world based on her prior experience in developing semester-long consulting projects with major companies for MBA students.

Court of Appeals Decision
A RESOUNDING VICTORY IN YUCCA FIGHT

On July 9, the U.S. Circuit Court of Appeals handed down a decision that is a major setback for the Department of Energyˇ¦s (DOE) effort to place nuclear waste in our state at Yucca Mountain. The District of Columbia Circuit Court of Appealsˇ¦ decision reinforces the State of Nevadaˇ¦s position that the science used by the Department of Energy is not sound nor is it safe, and that the 10,000-year standard used by the Environmental Protection Agency (EPA) is woefully inadequate and is inconsistent with the Congressionally-mandated recommendations of the National Academy of Sciences.*2

It is important to note that the court vacated the primary EPA rule governing the project, holding that the EPA deliberately rejected the sound advice of the scientific community and adopted a standard that is not safe. The EPA chose to ignore the National Academy of Sciencesˇ¦ recommendation of a health standard that would protect the public for between 300,000 and one million years when the repository would be experiencing its peak radiation hazard. Instead, the EPA opted for the expeditious ˇV but much more dangerous and indefensible ˇV standard of 10,000 years. The State of Nevadaˇ¦s legal team has serious doubts if the EPA can now adjust its science in such a way to fit the 300,000- to 1-million year standard, given Yuccaˇ¦s unique and porous geology.

Second, and just as important, the court vacated the Nuclear Regulatory Commission (NRC) rule governing repository licensing. This means there is currently no rule against which to license the project. The NRC will have to wait until EPA puts out a new rule, and it too will have to promulgate a new rule. This is often a costly and time-draining maneuver, one that can sometimes ˇV if successful ˇV take up to a decade to complete. For this to be accomplished, DOE will have to prove what our state has always wanted it to prove ˇV that the geology of the mountain is sufficient to retard radiation hazards to a safe level for all time. It is highly unlikely DOE can succeed in this endeavor.

Based on this recent ruling, it is obvious that the EPA deliberately adopted a standard that runs contrary to the health, safety and well-being of the citizens of Nevada. Prior to this ruling, the State of Nevada has helped provide funding for the stateˇ¦s legal team, and in February 2002, I exercised my Notice of Disapproval to the U.S. Congress (Governorˇ¦s veto) upon hearing of the decision to recommend Yucca Mountain as a nuclear repository.

I would like to congratulate Attorney General Brian Sandoval and the stateˇ¦s talented legal team for working so hard and so successfully in bringing about this important victory. There will no doubt be an appeal from the DOE in the coming months, but I am confident that the latest ruling has struck a significant blow in favor of the welfare and safety of all Nevadans.*3

Kenny Guinn, 67, earned undergraduate and graduate degrees in Physical Education from Fresno State University and later obtained a doctorate in Education from Utah State University in Logan. He was named Superintendent of Schools in Clark County and served with distinction in that position until 1978.

In his work for the Clark County School District, Guinn was recognized as an effective administrator committed to educational excellence at a time when the county was experiencing exponential student growth. His service to Clark County students was honored when Kenny C. Guinn Junior High School was named for him.

In 1978, Guinn began applying his management skills in business as Administrative Vice President for Nevada Savings and Loan in Las Vegas, which later became PriMerit Bank. At PriMerit, he was appointed as Chairman of the Board of Directors of the Las Vegas-based bank. Soon thereafter, Guinn was recruited to the energy business as the President of Southwest Gas Corporation and eventually became Chairman of the Board of Directors of that utility in 1993.

In 1994, Guinn was recruited by the University of Nevada Board of Regents to serve as interim president of the University of Nevada-Las Vegas.

In addition to his one-year term at UNLV, Guinn served the state in leadership roles on a variety of committees and commissions, including the Clark County Community College Advisory Committee, the UNLV Foundation Board of Trustees, the White House Conference on Children and Youth, among others.

Guinn has also worked in his community in a variety of volunteer roles, ranging from involvement in the Boy Scouts and Pop Warner Football to the United Way of Southern Nevada and the Southern Nevada Independent Youth Athletic Association.

Kenny spent his boyhood in the small, Central Valley town of Exeter, California where he met Dema, his wife of 47 years. Kenny Guinn believes in families.

Dr. Kenny Guinn is now the Governor of Nevada, U. S. A. at his second term.

Goff Gonzalez, 43, has been a member of the Clark County Bar Association since 1986. Goff Gonzalez is a past member of the State Bar of Nevada Functional Equivalency Committee, the Supreme Court of Nevada Commission on Jury Improvement, and is a former Regional Chair of the State Bar of Nevada Fee Dispute Committee. In 2003, she received the State Bar of Nevadaˇ¦s Access to Justice Committeeˇ¦s Attorney of the Year Award. She has also served as a mentor in the Attorney-Law Student-Mentor Program at the UNLV William S. Boyd School of Law and is a former Secretary of the Latin American Bar Assocation.
