EDWARDS REVIEW-JOURNAL Despite heavy rain and snow, retail sales across Nevada rose 9.4 percent in January to $3.19 billion while Clark County sales jumped an even higher 10.8 percent to $2.4 billion, officials reported Thursday. For the first seven months of fiscal 2005, Nevada merchants have now sold $24.88 billion in goods for a 14.7 percent increase -- and taxes based on the sales are now $25 million ahead of projections, state Taxation Department officials said. "Our sales activity was quite remarkable when considering the severe weather that hit our state in January," Gov. Kenny Guinn said in a statement. "This performance while major highways into our states were clogged by snowstorms is yet another indicator of how strong Nevada's economy is and how our state continues to make strides in diversifying itself." Carole Vilardo, president of the Nevada Taxpayers Association, was more impressed with sales for general merchandise stores, which showed a 10.3 percent increase over the same month last year, the biggest increase of 10 categories of taxable sales. "That's really quite amazing," Vilardo said. Gibson Jr. Diana Hampton Kenneth Walter Long Michael L. Miller Henderson's newest elected post is also its most hotly contested, as four attorneys vie to become municipal court judge for the city's recently created Department 3. The nonpartisan race features David Gibson Jr., Diana Hampton, Kenneth Long and Michael Miller. Early voting got under way Saturday and runs through April 1. Election Day is April 5. Unless one candidate earns more than 50 percent of the vote, the top two finishers will advance to the June 7 general election. David Gibson Jr. is a Henderson native who has worked as a private attorney since 2002. The married father of three also currently works as a pro tem justice of the peace in Laughlin and other outlying parts of Clark County. Gibson's father is a longtime Clark County public defender, his uncle is Henderson Mayor James Gibson. He described the two men as his legal role models. "I believe the Gibson name stands for good in this community, and I embrace that. However, I am my own person, and I want people to judge me on my own merits and my own ability," he said. Diana Hampton spent almost three years as a Henderson deputy city attorney before resigning the $78,548-per-year job earlier this year to concentrate on her campaign for judge. "In addition to serving the public, I have also served in the private sector, so I have a good world view," she said. Hampton is married to a Henderson Police officer and has one child. She has lived in Southern Nevada for six years and worked as a trial attorney for five years. Since 2001, Kenneth Long has worked as prosecutor in North Las Vegas. Before that, he spent three years with the Clark County district attorney's office, prosecuting drunken drivers and handling special assignments. The Southern Nevada native and married father of four also spent two years as an FBI agent in Lewiston, Idaho. Long described himself as "well-equipped to reduce the backlog presently in Henderson" and said he is "ready to change the perception that Henderson is easy on domestic violence cases." Michael Miller is a lifelong resident of Clark County, who retired after 25 years as a deputy public defender for the county. He presently serves as a pro tem municipal judge and a pro tem justice of the peace in Henderson. "I've had the opportunity to work with and observe judges, prosecutors, police, victims and defendants," he said. "My years of experience best qualifies me to serve the community and the court." Kenny Guinn today announced the appointment of Susan L. Gray as Administrator of the Nevada Equal Rights Commission (NERC). Gray is currently Deputy Attorney General representing the commission. Gray, 34, a University of Baltimore School of Law graduate (1998) and resident of Henderson, has devoted much of the past five years as the Nevada Equal Rights Commissions attorney. Gray has extensive experience interpreting equal rights case law, and has worked closely with NERC staff and federal programs that oversee equal rights issues. She will be responsible for overseeing the Nevada Equal Rights Commission, which handles discrimination complaints relating to race, national origin, color, religion, sex, age, and disability, when the discrimination is linked to housing, public accommodations or employment. A strong Equal Rights Commission is crucial to protecting the rights of Nevadans, and I selected Susan Gray to lead the commission because I knew she would continue the legacy of success that Lynda Parven created before leaving the agency last month, Gov. Guinn said. Parven accepted a promotion to deputy administrator of the Department of Employment, Training and Rehabilitations (DETR) Employment Security Division. Birgit Baker, director of the department, said Gray has a solid working knowledge of the department and NERC. YUCCA MOUNTAIN DEVELOPMENTS BODE WELL FOR STATE By Dr. Kenny C. Guinn*1 The most recent revelation of falsified documents related to the Yucca Mountain nuclear waste project in Nevada further underscores what a dangerous and unnecessary project the federal government has sponsored for the past two decades. Last weeks news reports that U.S. Geological Survey employees falsified documents are a clear reminder that the Yucca Mountain project has never been presented with all of the facts in plain sight. The State of Nevada has had to fight the battle against Yucca Mountain on an uneven playing field that has apparently been lined with deception. And, in defiance of this obvious handicap, the State of Nevada seems to have finally taken the upper hand. Since a perplexing vote by Congress in July 2002 to override my veto and permit the Department of Energy to move ahead for licensure to construct the facility, developments have all been very much in the State of Nevadas favor regarding the future of Yucca Mountain. In July 2004, after years of litigation, the U.S. District Court for the District of Columbia handed Nevada a major legal victory in the fight to stop the nuclear waste dump when it threw out the Environmental Protection Agencys radiation health protection regulations that had been tailored for Yucca Mountain. The courts ruling effectively stopped DOE because Yucca Mountain, by virtue of its porous geology and other fundamental flaws, is incapable of meeting the more stringent health and safety regulations required by the court. Since then, the Bush Administration cut the FY 2006 Yucca Mountain budget in half, and the DOE has acknowledged a series of missed deadlines. Indications of waning support for the project from the nuclear industry have also followed, with statements by utility industry representatives advocating de-linking the repository from the industrys perceived ability to proceed with new nuclear power plants. Then, last week, Secretary of Energy Samuel Bodman announced that scientists working on DOEs Yucca Mountain project had falsified reports and data in critical site suitability and repository performance areas. The revelation set off a storm of outrage, not only from Yucca Mountain critics, but also from project proponents who viewed the falsification of scientific data and studies as a potentially fatal blow to Yucca Mountain. For Nevadas citizens, the recent revelations are good news. Given the events of past days, the question of if Yucca Mountain will crumble has become a question of when. I am extremely proud of the fact that Nevadans have chosen to fight this repository through all of the proper channels, in an intellectually honest and above-board manner. Those who have been involved are to be commended for being so vigilant during this fight. -------------------------------------- Reference *1. Cooley School of Law, Lansing, Mich. The race for the Las Vegas Municipal Court Department 5 judgeship pits a two-term incumbent against a perennial challenger. Judge Cedric Kerns, first elected in 1997, is being challenged by attorney Mathew Harter. Because there are only two candidates, the nonpartisan race will be settled in the April 5 primary. Kerns said his record speaks for itself. He has been instrumental in helping remove repeat offenders from the system through the Habitual Offender Prevention and Education program, commonly called the HOPE Court, he said. "I love this job," he said. "It is one of the most rewarding jobs I've ever had." He said law enforcement endorsements and what he calls strong backing by attorneys and other judges should help voters decide. Harter criticized the judge for not vowing to refuse campaign contributions from strip club owners and for not refusing a recent $11,000-a-year pay increase. The position pays just over $128,000 a year. "That money should be going toward improving the system, not in the judge's pocket," Harter said. He vowed to give the $11,000 to charity if he wins. He also said judges, especially, should not take campaign contributions from strip clubs. "I have a problem with it because judges are supposed to be held to a lot higher standard than most politicians," he said. Kerns said he has taken contributions from strip club owners and he would do it again. "These are legitimate businesses," he said. He added that if there were any questions about his credibility, he wouldn't have been elected president of the Nevada Judges Association. Kerns criticized Harter for trying nine times to become a judge, five through election and four through the appointment process. Harter said he has wanted to be a judge since law school and saw nothing wrong with persistence. Kerns touted the HOPE program, which targets serial repeat offenders for rehabilitation. He said the 27 people involved in it had a total of 8,000 violations against them when they entered the program. To date, he said, their arrest rate has been reduced 74 percent. Harter said he was not familiar enough with the program to comment on it. He said, however, that he believes too often people are led into programs for rehabilitation instead of simply punished because of a lack of jail space or something similar. Kerns has criticized Harter because Harter was sued for malpractice. The NAARC is a diverse group of community leaders representing the major Asian Pacific Islander population that helped determine the final outcome of the 2004 presidential elections, Carlota said.*4 With participatory leadership, the newly elected national chairman said that he would work towards implementing a 5-Point Plan which are to: 1.) Broaden the base of membership nationwide by appointing ethnic co-chairs for each nationality, and have the co-chairs recognized by the State Republican Committees in their respective areas; 2.) Work for the appointment of qualified Asian Pacific Americans in federal, state, and local governments and the private sector; 3.) Encourage and support qualified Asian Pacific American Republicans to run for public office in the federal, state and local levels; 4.) Steer the ethnic republican groups to integrate with the activities of the State and County Republican Committees during primaries, federal, state and local elections; and 5.) In a letter to Attorney General Alberto Gonzales and FBI Director Robert Mueller, the Nevadans requested immediate action be taken to "preserve and protect" records related to government's bid to store 77,000 tons of nuclear waste at the site, 100 miles northwest of Las Vegas. The request by Sens. Senator John Ensign today received the Spirit of Enterprise award from the United States Chamber of Commerce for his voting record during the 2nd session of the 108th Congress.*2 For Americas economic future to remain prosperous, we must encourage pro-growth policies so that we continue to be the leader in innovation and entrepreneurship, Ensign said. I am honored to be recognized by the Chamber. The U.S. Chamber of Commerce gives out the award based on key business votes by Congressional members and ranks them in its annual publication, How They Voted. Members of Congress who support pro-business positions on at least 70 percent of the key votes receive the award. Senator Ensign was well above that mark with a 91 percent for votes cast on pro-growth legislation. It is critical to have members of Congress fighting for American business and their employees at this time of economic expansion and opportunity, said Thomas J. Donohue, Chamber President and CEO. John Ensign is a leader who has voted time and again to create jobs, improve our domestic security, and promote economic expansion. Pro-growth policies are critical to small businesses in Nevada because they stimulate the economy and promote job creation, Ensign said. Senator Ensign was raised in northern Nevada and moved to southern Nevada where he graduated from Clark High School. He attended UNLV and earned a Bachelors degree from Oregon State University. He received his Doctor of Veterinary Medicine degree from Colorado State University in 1985. Senator Ensign immediately began practicing veterinary medicine and opened the first 24-hour animal hospital in Las Vegas. Ensign has taken the lead on technology issues as well. His "Dot Kids" legislation creates a subdomain on the Internet where children can explore the Internet without the fear of being exposed to material parents may deem inappropriate. His bill to delay the 700 MHz spectrum auction from moving forward was a critical step toward improving our nation's wireless network. Both were signed into law by President Bush. Ensign spends his workweek in Washington and his weekends in Las Vegas with his wife, Darlene, and their three children-Trevor, Siena, and Michael.
