NEVADA RECEIVES DROUGHT DESIGNATION FROM USDA

CARSON CITY - U.S. Department of Agriculture (USDA) Secretary Ann Veneman has granted Gov. Kenny Guinn・s request to designate all 17 Nevada counties as drought affected. The designation makes all Nevada agricultural producers who suffered a loss eligible for emergency farm assistance programs.

:I am extremely pleased Secretary Veneman has granted Nevada this primary disaster designation in a timely manner,; said Gov. Guinn, who made the request in August. :Nevada・s farmers and ranchers have taken a hit for the fifth year in a row due to drought and related insect infestation.;

The USDA has completed its review of Nevada・s Damage Assessment Reports that were provided by Farm Service Agency・s Nevada Executive Director, Roger Van Valkenburg. Based on that review, USDA has determined that all 16 counties and Carson City sustained sufficient production losses to warrant a Secretarial disaster designation.

Don Henderson, Director, Nevada Department of Agriculture said, :On behalf of Nevada・s farmers and ranchers and the Department, we applaud Governor Guinn・s leadership in getting this important designation. Some Nevada counties experienced a 100 percent loss in certain crops based on availability of water and Mormon cricket and grasshopper infestation.;

The designation took effect on October 12, making all qualified farm operators eligible for low-interest emergency loans from the Farm Service Agency (FSA), provided eligibility requirements are met. Farmers and ranchers in Nevada have eight months from the date of the declaration to apply for the loans to help cover part of their actual losses. FSA will consider each loan application on its own merits, taking into account the extent of losses, security available and repayment ability. In addition to the emergency loan program, this USDA designation also opens the door for Nevada agricultural producers to apply for any future farm assistance program that may be funded by Congress over the coming year. Interested farmers and ranchers can contact their local FSA office for further information on eligibility requirements and application procedures for these and other programs. Augustine's office gets national prize
Embattled controller presented award

CARSON CITY -- Embattled state Controller Kathy Augustine announced Monday that she has been presented a national certificate of achievement for work performed by her office.

The Government Finance Officers Association presented Augustine the certificate of excellence in financial reporting for the sixth straight year. Augustine is the state's chief financial officer. Her office makes sure state expenditures are proper and authorized.

The award was presented to Augustine, although the state Ethics Commission in September fined her $15,000 for three violations of a state law by having members of her staff work on her re-election campaign while on state time.

Augustine also faces a probable impeachment hearing next month in the Legislature over the violations.

She has contended that the violations had nothing to do with the operation of her office and that she will fight the impeachment attempt.

The certificate of excellence is the highest form of recognition for government accounting. The award was presented to the controller, although most of the work was carried out by her staff.

She also received the Award for Outstanding Achievement in Popular Financing Reporting for her annual publication Citizens Assets.

Augustine also announced her office so far has collected more than $3.6 million owed the state through its debt collection program. Twenty-three state agencies and boards have contracted with the controller's office for debt collection services.

Attorney sues casinos for using card counting system

A Las Vegas attorney who has represented dozens of card counting clients filed another lawsuit Monday, this time to stop Nevada casinos from using a computerized card counting system that boosts the house's odds of winning at blackjack.

The system, which is sold by the MindPlay division of Alliance Gaming Corp., was designed to protect the integrity of blackjack games by ensuring that cards are dealt out in the same order they are shuffled, industry sources said.

But Bob Nersesian, who represents gambler John Allen in the lawsuit, said the computer systems are being used by some Nevada casinos to track cards, effectively limiting blackjack players' chances of winning.

Allen, a Los Angeles attorney, targets the Nevada Gaming Control Board and its members -- Chairman Dennis Neilander, Bobby Siller and Scott Scherer -- the El Dorado Hotel & Casino in Reno, Bally Gaming and MindPlay in his lawsuit. Neilander declined to comment on the lawsuit Monday.

Al Rogers, a professional advantage gambler who also claims to have been duped by the system, called the MindPlay system a "dastardly cheating device."

"(The dealers) shuffle up whenever the count goes positive over and above a certain criteria. It's universal there and the dealers aren't all competent card counters, so it's obvious they are getting outside information," he said.

"The casinos already have everything (stacked) in their favor and they want to make sure no (players) ever win. It's another example of corporate greed wanting to slaughter the cow instead of milking it, and the poor tourists just line up to get killed," Rogers said.

Ironically, Nersesian's latest suit claims the MindPlay system does electronically -- and more accurately -- what many of his former clients have been banned from casinos for doing on their own: counting cards.

Nersesian has represented about 40 gamblers who have been abused by casinos for counting cards or using other natural advantages to improve their chances of beating the house.

Casinos generally ban card counting by patrons and, in many instances, have beaten and illegally detained gamblers they suspected of card counting.

Nevada's highest court, as well as courts in other gambling states, however, has ruled card counting is legal since players don't manipulate any cards or use mechanical devices. Rather, they do nothing more than use normal intelligence much as a bridge player would use while watching other players.

The MindPlay system is being used at the El Dorado, which is where Allen was playing.

It is also used in the Flamingo on the Strip in Las Vegas, at Crystal Bay casino in Reno and at a major casino in Aruba.

The MindPlay system uses an optical scanning device to read markings embedded in the face or along the edges of cards. The system then records each card's position within a deck as it is being shuffled and when they are dealt out. The system can be adapted for single-deck blackjack games, like those at the El Dorado, and for multiple-deck games that use automatic shufflers.

With that information, the computerized system can continually calculate the odds of the house winning each hand, and that's the problem with the system, according to Nersesian.

"People in the casino, such as shift managers and surveillance, can call up what's going on in the game and signal the dealer (to reshuffle). There are read-outs in the casino," Nersesian said.

Other players who asked not to be named said casinos place a light under the blackjack table that dealers can see to alert them when to reshuffle the deck because the odds are turning against the house.

Alliance Gaming Executive Vice President Mark Lipparelli denied the system affects the level of win or loss of individual players, although he declined to comment on specific claims in the lawsuit.

Another industry source said some casinos use the MindPlay system to track gamblers' wagers for calculating comps and government reporting purposes.

In a letter to an advantage player in 2003, Neilander wrote that the MindPlay system is acceptable because a casino is not a person under Nevada gaming regulations. Neilander could not be reached for comment on Monday.

However, Nersesian said it is illogical to consider a casino dealer is anything other than an individual under Nevada statutes.

Don Carano, president of the El Dorado, could not be reached for comment on the lawsuit.

The MindPlay system previously was used at the Las Vegas Hilton when it was owned by Caesars Entertainment, company spokesman Robert Stewart said.

The hotel-casino, which was bought by Colony Capital this summer, removed the MindPlay system after the acquisition, Las Vegas Hilton spokesman Ira Sternberg said.

Stewart said the MindPlay system may also have been installed in other Caesars Entertainment properties, but he did not disclose which properties may be involved.

Bally Gaming and Systems, the slot machine division of Las Vegas-based Alliance Gaming, offers the computerized player and card tracking system through its Bellevue, Wash.-based MindPlay subsidiary, which it acquired in February.

Audit finds more police needed, current spending could be cut

As voters consider a sales tax hike for more police, Sheriff Bill Young last week said the Metropolitan Police Department is a tightly run organization worthy of more taxpayer money.

Young earlier this year called for an outside audit of the department before going to voters for more money.

The audit found the number of officers has increased proportionately with the local population, but that calls-for-service have outpaced staffing and that more officers are needed for proactive policing.

"The sheriff has told us and the public he will take the findings of the audit seriously and make changes, and we should expect him to do that," Commissioner Rory Reid said. "In times like these we need additional officers. And, at the end of the day, the community will agree and Question 9 will pass."

Thou shalt not use or copy softwear for which you have not paid. (7). Thou shalt not use other people's computer resources without authorization. (8). Thou shalt not appropriate other people's intellectual output. (9). Thou shalt think about the social consequences of the program you write. (10). Thou shalt use a computer in ways that show consideration and respect.

A sucessful businessperson always know the old rule that says "It's easier to keep an existing customer than to find a new one." In online customer relationships, this rule is just as important. Your goal should not only to get new visitors, but to cultivate your customer base to yield repeat sales, services, and referrals from satisfied purchasers, clients, and patronagers. "Besides a good product or service, there are only three things you need for successful online customer relations: strong communication, common courtesy, and exemplary customer service. Unfortunately, these old-fashioned values are often missing in many companies' online promotional communication." *9

Challenger says incumbent facing racketeering allegations
Commissioner's attorney suggests defamation

Clark County Commission challenger Jerry Tao said Thursday that Commissioner Chip Maxfield is facing racketeering charges as Tao's campaign implied in a recent poll of voters.

A day earlier, Maxfield denied he faces racketeering charges and called for a criminal investigation into the automated phone poll.

But Tao said Maxfield's complaints were inappropriate because a lawsuit involving racketeering allegations is expected to be filed today against the commissioner.

Maxfield's attorney said Thursday that the allegations are baseless, and that the lawsuit is nothing but a smoke screen from opponents who slandered Maxfield by suggesting he is under investigation.

"It (the lawsuit) is a defense against what has already been a defamation," attorney Don Campbell said.

Campbell said those behind the poll can be held accountable for defamation in civil court and might face federal criminal charges.

Maxfield has not been implicated in the federal corruption investigation that brought the indictment of several former commissioners and current Commissioner Mary Kincaid-Chauncey.

Tao said he learned before the poll was conducted that a lawyer planned to file a lawsuit against Maxfield that involved "serious allegations."

A news release distributed by Tao on Thursday said, "The attorney specifically noted that they have been investigating Mr. Maxfield for violations of the federal racketeering statute (known as RICO)."

Tao, a deputy district attorney, later said RICO violations can be brought against someone in either a criminal case or a civil lawsuit.

He could not name the plaintiffs or list the allegations. Tao referred questions about the lawsuit to the law firm of Lynch, Hopper and Salzano.

"I am not saying I know what is in the lawsuit," Tao said. "The reason we polled on it is because there were investigators asking very serious questions, and we thought it would be worthwhile to see whether this is something I could use in a (campaign) flier."

Sergio Salzano, a lawyer representing developer Brent Lovett in the pending lawsuit against Maxfield, said he has no connection to Tao's campaign. Salzano said he has never discussed plans to sue Maxfield with Tao or anyone with his campaign.

Salzano said Lovett plans to file a lawsuit against Maxfield today. The lawsuit includes many of the same allegations Lovett leveled against Maxfield last month in a complaint Lovett filed with the state Ethics Commission.

The complaint stems from a March 2001 vote on Lovett's application to rezone property on Buffalo Drive and Alexander Road from residential to commercial.

The county Planning Commission denied the request after opposition from neighbors and a county staff recommendation against the proposal.

Lovett said Maxfield never should have voted on the request because of a conflict of interest with Lovett, who had criticized Maxfield's civil engineering work during a construction defect lawsuit involving the Fiesta condominiums near Meadows mall.

After the vote, Maxfield embarked on a campaign against Lovett, Salzano has said.

Since then, Lovett's property received 17 citations for county code violations, including overgrown weeds and not having a fence around the property to prevent trash dumping. Before the vote, the property received no citations, Salzano said.

"I know Mr. Tao's people have been in contact with my client's people," Salzano said. "I wouldn't say he (Tao) is acting irresponsibly, but he is calling attention to a lawsuit that will probably be filed tomorrow."

INFLUENZA VACCINATION GUIDELINES

During the past several days, there have been a number of media reports concerning the shortage of influenza vaccine in Nevada and throughout the country. The unanticipated shortage is due to a manufacturing problem experienced by Chiron Corporation, one of the two influenza vaccine manufacturing companies.

In light of this situation, the Nevada State Health Division is following the interim recommendations from the Centers for Disease Control and Prevention (CDC), in coordination with its Advisory Committee for Immunization Practices (ACIP), during the 2004-05 influenza season. The recommendations emphasize priority groups for vaccination with inactivated influenza vaccine. These groups are:

All children aged 6 to 23 months;
Adults 65 years and older;
Persons aged 2 to 64 years who have underlying chronic medical conditions (as defined on the CDC Web site);
All women who are or may become pregnant during the influenza season;
Residents of nursing homes and long-term care facilities;

INFLUENZA VACCINATION GUIDELINES

During the past several days, there have been a number of media reports concerning the shortage of influenza vaccine in Nevada and throughout the country. The unanticipated shortage is due to a manufacturing problem experienced by Chiron Corporation, one of the two influenza vaccine manufacturing companies.

In light of this situation, the Nevada State Health Division is following the interim recommendations from the Centers for Disease Control and Prevention (CDC), in coordination with its Advisory Committee for Immunization Practices (ACIP), during the 2004-05 influenza season. The recommendations emphasize priority groups for vaccination with inactivated influenza vaccine. These groups are:

All children aged 6 to 23 months;
Adults 65 years and older;
Persons aged 2 to 64 years who have underlying chronic medical conditions (as defined on the CDC Web site);
All women who are or may become pregnant during the influenza season;
Residents of nursing homes and long-term care facilities;
Children aged 6 months to 18 years on chronic aspirin therapy;

The City of Las Vegas and Thai Cultural Arts Association (TCAALV) presented Thai Performing Arts Appreciation Day 2004 at Charleston Heights Arts Center in Las Vegas, Nevada on September 15, 2004. It was co-sponsored by City of Las Vegas, Washington Business and Technology Institute (WBTI), Kids for a Better Society, Asian Leaders, among others.

U. S. Senators Harry Reid and John Ensign had been invited to attend the Event and Party as the Guests of Honor. Kathie Ambrosio reprented U. S. Senator John Ensign to offer Washington Business and Technology Institute and Thai Cultural Arts Association of Las Vegas the Senatorial Recognition Awards. Nancy Diaz represented Senator Harry Reid. Special Guests by Washington Business and Technology Institute to present including U. S. Senator John Ensign(represented by Kathie Ambrosio), Supreme Court Justice Michael Douglass, Distrct (Family Court) Judge Cheryl Moss, Las Vegas Township Constable Bobby G. Weekend hobby show at Sands Expo ready to reveal the year's hottest toys

***Model trains will be on display at HobbyVisions. ***Model airplane enthusiasts are expected to flock to the annual HobbyVisions show at the Sands Expo. (Check the newspaper please.)

It may come as a shock, but Las Vegas is a mecca for something besides gambling.

"Las Vegas is the best trade show city in the world, because of the attractions that are here," says Rob Gherman, director of the HobbyVisions International Show going on through Sunday at the Sands Expo.

The trade show, spread over 300,000 square feet, began Thursday, but is only open to the public Saturday and Sunday.

"Las Vegas people in general are amenable to hobbies," Gherman says. "There are great hobby clubs here."

This is the second annual HobbyVisions show. Last year's event, also held in Las Vegas, attracted 15,000 people.

This year, there are 300 booths, down some from last year because of a competing show that takes place next week in Chicago, according to Gherman.

On April 9, 2004, Judge Besty Kolkoski and her husband Dick honor Dr. and Mrs. Tony Lei with a nice reunion dinner. The location is at the Cheese Factory in Summerlin. The party is held by Judge Kolkoski in celebrating of Easter for the two famillies.

The Summerlin of Las Vegas has been elected as the First Place in among 12 ranking communities nationally of United States the ideal and best selling homes for big builders in 2000 again.*1 South Shores is one of the important district of Summerlin together with Desert Shores, Sun City, among others. The beautiful lakes centered in this area are one of the greatest attractive- ness of Las Vegas for millions of visitors all around the world. People would enjoy dreamly the sun rising and sun setting of the calm, clean, and nice scenes of these artificial and great work on the lilltle bridges. These bridges are built above the golden and beautiful waves of the lakes which are surounded by elegant residences. People love Summerlin. People love this Las Vegas' mighty fine! Dr. Tony Lei has been re-elected as a Director of South Shores Community Association with the highest poll by voters in December 2002.

Judge Betsy Kolkoski of Las Vegas Minicipal Court did also invite Dr. and Mrs. Tony Lei with a reunion dinner at Village Pub and Casino in Summerlin on February 28, 2001. Accompanied by her husband to the dinner, the Judge was bright and pleasent. In 1971, Judge Kolkoski graduated from the University of Cincinnati College of Law with Juris Doctorate degree. As Nevada's Elder Rights Atnorney, an Associate Fellow of the Culture Institution (CI) and Chairperson of the Aging Services Study Committee of Washington Business and Technology Institute (WBTI), she advocated statewide for the legal rights of senior and elder abuse prevention. Her research projects and papers presented together with former Attorney General Frankie Sue Del Papa to the national conferences were publicized by WBTI locally and internationally. CI has been led by Dr. Sue Fawn Chung as its Director and Fellow. She is an Associate Professor and former Chairman of the History Department at UNLV. Dr. Chung was also named one of the two Nevada advisors to the National Trust for Historic Preservation in 2000.

"PAI is exploring such themes as computer and quantitative analysis for administration, seniors power by voting, economic renewal, educational technology, elder abuse, social security and Medicare, and the important relationship between faith and public policy," Dr. Lei noted. "We have worked to provide a setting of ideas in which the principles and perspective of the program come into contact with leading issues of the day in order to improve the quality of life of all our Nevadans."

The value of an academic institute should also put an eye on community service aside from its academic research. Take only one example, for the positive effort of the research and promotion of the seniors benefit, the Institute has done sizable works and received valuable results. At the end of 20th and in the very early of this 21st century, Associate Fellow of the Public Administration Institution (PAI) of WBTI, Elder Rights Attorney Besty Kolkoski of the Nevada Division for Aging Services (NDAS), with Juris Doctor degree of University of Cincinnati College of Law held the Forth Anniversary Meeting of the Nevada Elder Abuse Prevention Council (NEAPC) as Co-Chairpersons with Nevada Attorney General Frankie Sue Del Papa. Betsy did a research paper on elder abuse prevention through quantitative methodology. Both of them had received a fruitful consequence on the prevention of elder abuse with their cooperation of the NDAS and the Office of the Nevada Attorney General. Associate Fellow Sheri Vogel of PAI, a Juris Doctor degree holder of Detroit College of Law, Detroit, Michigan, has been the Project Administrator of the City of Las Vegas Senior Citizens Law Project since 1986. Sheri has obligatory assisted to and solved the concrete benefits and difficulties of seniors for many thousand cases. Her effort to help Las Vegas Seniors has won a lot of applauses. The President of Washington Business and Technology Institute (WBTI), Dr. Tony Lei, had been a member of the Las Vegas Senior Citizens' Advisory Board. He is now also a member of the Senior Advisory Committee of the U. S. Congresswoman Shelley Berkley . Dr. Lei, elected as Executive Vice President of Seniors United in 2000, had been supported both by the educational and political sectors to get advance in leading the research and promotion of the seniors benefit, social security, and Medicare.*3

"WBTI is a very well respected and integral part of this community. To be an Associate Fellow of its Public Administration Institution (PAI) is a very prestigious honor for me. I am also grateful to be joining such a distinguished panel of professionals who are committed to improving the lives of our citizens in this community," said Judge Ann Zimmerman at the time when she was a Deputy Attorney General of Nevada.*4

In the first paragraph of the article entitled "Election Winner Judge Kolkoski Recognizes Dr. Tony Lei as a Great Leader,' It was wrote that, "During the congratulating conversation from Dr. Tony Lei to Judge Betsy Kolkoski for her re-elected as a Las Vegas Municipal Court Judge, she told him that Dr. Tony Lei is really a great leader.*5

U. S. Congresswoman Shelley Berkley wrote Dr. Tony Lei early April this year from her U.S. Congress Office in Washington, D. C. : "I can not thank you enough for all you do for me, my dear friend. I just read the 'Washington Business and Technology Institute' publication. It was wonderful!"*6

Seasons greetings are significant to famillies! With honor as the Assistant Democratic Leader of U. S. Senate, Senator Harry Reid wrote Dr. and Mrs. Tony Lei on January 11, 2001 from his office in Washington, D. C. : "The holiday season is a time for remembering the good things that have happened during the year, for reflecting on the many blessings of our lives, and for renewing the bonds of love and friendship that make our lives special."

The famous political leader from Nevada continued his literary and intimate writing that, "This year has been eventful for the Reid family. Our first child, Lana, and our three grandchildren live in the Washington area. Roary and three more of our grandchildren live in Las Vegas. Leif is in Reno with two more grandchildren and have just told us another is on the way.

Josh just passed the bar, is living in Reno and also has announced our new daughter-in-law is expecting. Finally, our youngest, Key, lives in the Washington DC area with our newest grandchild. So, as you can see, we have the pleasure of grandchildren in each of our frequent stops, Las Vegas, Reno and Washington."

The Bible says: "Behold the fowls of the air: for they sow not, neither do they reap, nor gather into barns, yet your heavenly Father feedeth them. Are ye not much better than they?" (Matthew 6:26) Take what the Senator says to Dr. Lei in his letter that, "On behalf of Landra and our family, I want to thank you thinking of us during this holiday season. Each holiday greeting reminds us that we are truly fortunate to have so many friends and loved ones with whom to share this special time." And if a humble individual like Dr. Lei may be treated so friendly by our Senator Reid, obviously everyone of us in Nevada would be taken care by his extended kindness. And this be our mode: "In God is our trust!"

His love to his family and his friends revealled his dignified and humane spirit through his words in the letter. For a great and powerful person like him to have such a beautiful and kind heart is really the glory of God. "Love must be sincere. Hate what is evil, cling to what is good. Be devoted to one another in brotherly love. Honor one another above yourselves," says the Bible. (Romans 12:9-10) At the end of the letter, the famous U.S. Senator says that, "The Reid family has been richly blessed and we look forward to the years ahead. I hope that the season brings happiness and good fortune to you and your loved ones. With warmest regards."*7
