Justice Michael Douglas, the first African American justice in Nevada’s history, was appointed to the Court in March 2004 to fill the vacancy that resulted from the death of Justice Myron E. Leavitt. Justice Douglas’s appointment to the Supreme Court is the culmination of a 22-year legal career in Nevada that began by chance when he accepted what he thought was going to be a temporary job with Nevada Legal Services.*4 Michael was elected in November 2, 2004 as Justice of the Nevada Supreme Court. Justice Douglas, a native of Los Angeles, came to Las Vegas in 1982 from Philadelphia, Pa., where he had been working in private practice. The justice said he chose Las Vegas because he wanted to move back west and had a cousin living in the city. After two years at Nevada Legal Services, Justice Douglas was hired by the Clark County District Attorney’s Office and served in the Civil Division until 1996. In January 1996, he was appointed to the Eighth Judicial District Court bench and was retained in the election later that year, serving until his appointment to the Supreme Court. At the District Court, he served as Business Court judge along with handling a variety of civil and criminal cases. He was elected Chief District Judge in October 2003. A graduate of California State College, Long Beach, in 1971 and the University of California Hastings College of Law in 1974, Justice Douglas has been a member of the Judicial Council of the State of Nevada and Vice President of the Nevada District Judges Association. He is president*3 of the Nevada American Inns of Court, an organization of judges, lawyers and law students that promotes*6 excellence and civility in the legal profession. He has been active in groups fighting domestic violence and also has served on a variety of law-related groups, including two years on the Nevada Law Foundation Board and seven years on the State Bar of Nevada, Southern Disciplinary Board. Justice Douglas, who is married and has a daughter and two grandchildren, has been a longtime supporter of the youth in California and Las Vegas. He was a sports volunteer and coach and has been a frequent speaker at Las Vegas area schools. From 1996 to 2003, he was the judicial sponsor of the annual Spirit of the Arts Contest, a competition for student artwork emphasizing Nevada themes and spirit. Strengthening Our Economy ... wbti: ***** By Harry M. ReidThis week, the Senate is working on next year’s budget. After years of policies that have put the burden of a looming recession on the backs of middle-class families, it is time that we restore fiscal responsibility and pass a balanced budget that lowers taxes for hard-working Nevadans. The budget the Senate offers cuts taxes, strengthens our economy and creates half a million good-paying jobs here at home.*1 With a slumping US economy spurred by the nation’s foreclosure crisis, our budget proposes both immediate help and long-term solutions. In the short term, the budget takes additional steps to improve the economy and address the housing crisis that has hit Nevada so hard. We will provide more than 20 million Americans an extension of Alternative Minimum Tax relief, and set aside funds for measures to extend unemployment insurance, provide home heating and nutrition assistance, and rebuild our crumbling roads and bridges. For the long term, our budget calls for meaningful investments in energy, education, and health care. These investments will create jobs, strengthen our classrooms, make college more affordable, protect our outdoors, and make Nevada the world leader in renewable energy. While we have proposed a budget that lowers taxes for the middle class, creates new jobs and turns our struggling economy around, the President’s budget calls for more of the same policies that have gotten our country in the shape it is in today: spending billions on tax breaks for Americans with incomes greater than $1 million, and digging our country even further into debt. I cannot, in good conscience, allow this to happen. I believe in cutting taxes – not for CEOs, not for oilmen, but for middle class families who need help most of all. Our bipartisan budget sets a path toward a stronger economic future and I look forward to an open, productive budget debate this week. Why? At their convention Saturday, Clark County Republicans tried desperately to drum up enthusiasm for "More of the Same" McCain, who came in third in Nevada's caucus. After Jim Gibbons admitted that he didn't caucus for McCain, the governor finally gave his endorsement, while acknowledging that McCain is an ardent Yucca Mountain supporter (http://www.lvrj.com/news/16429526.html) Rep. Dean Heller gave his half-hearted pep talk: "I'll be the first to say John McCain was not my first choice but he is my first choice today." Here's the kicker: When GOP Chair Sue Lowden reportedly got more crowd applause when she said she invited Ron Paul to the GOP state convention than when she told the group she invited McCain to the same event. Republicans have a big problem in Nevada. In the past year, Democrats have gained a 40,000 voter registration advantage and our two Democratic candidates have organized throughout the state, helping to turn out almost 120,000 Democrats to the Jan. 19th caucus. Now state Republicans have to hold their noses while they back their presidential nominee. Our Democratic candidates also prompted record turnout in caucuses and primary around the country, and they have raised more than five times the amount of money McCain has in his presidential bid. Democrats are better organized and ?most importantly ?more enthusiastic and ready for a change in the White House than our counterparts in the Republican party. Governor Jim Gibbons Authorizes Use of All Available Resources, Including Disaster Relief Funds, to Assist in Public Health Emergency - March 6, 2008 By Office of the Governor (NV), Dan Burns, Mark Denton, Valerie Weber, and Jennifer KungGovernor Jim Gibbons has instructed Department of Health and Human Services (DHHS) Director Mike Willden to use all available resources at the State’s disposal to put as many trained medical surveyors in the field as necessary to complete Bureau of Licensure and Certification (BLC) Focus Surveys as quickly as possible. In addition, the Governor has authorized DHHS to request the use of the State Disaster Relief Fund, if necessary, to assist the Nevada State Health Division in ongoing efforts to address public health concerns regarding unsafe medical practices at ambulatory surgical centers (ASCs) throughout Nevada.*1 “We are facing a public health crisis not only in the sense of certain facilities not adhering to common sense medical practices and thus placing patient safety in jeopardy, but also the perception from the general public that it is not safe to have procedures done that help save lives, namely a colonoscopy exam,?Governor Gibbons said. “Even after the state has taken multiple steps to inform medical professionals through issuing a Technical Bulletin and following up with personal phone calls to all ambulatory surgical centers in Nevada, not to mention the intense media coverage surrounding these events, I have been informed that BLC staff continues to see deficient procedures being performed during recent inspections.? “Government’s most basic responsibly is to ensure public safety. With the health of so many Nevadans seemingly at risk, as Governor, I feel it is imperative that we act swiftly and decisively to help restore public trust and to ensure that unsafe medical practices are halted immediately. We must act decisively on several fronts: complete surveys of centers performing these types of procedures as quickly as possible, provide additional education to practitioners charged with protecting the public health, and empower patients to ask tough questions of their service providers to help alleviate fears associated with this crisis. ? Governor Gibbons said he has received commitment from both the Centers for Disease Control and Prevention (CDC) and the Centers for Medicare and Medicaid Services (CMS) to lend immediate support to the State as it works with county health agencies to act swiftly to protect public health. The CDC is sending federal Infection Control and Epidemiology Inspectors to Nevada to team up with BLC Surveyors, and CMS has authorized funding to help pay for the temporary hiring of additional Surveyors and for overtime. CMS will also ask surrounding states for assistance by providing Nevada with additional trained surveyors. Earlier today, Governor Gibbons approved emergency regulations promulgated by the Nevada State Health Division in relation to ASCs. Those regulations mandate strict adherence to manufacturer’s recommendations for the use of medications. A Focus Survey—conducted by two Registered Nurse Surveyors who have successfully completed specific training in observing and questioning surgical protocols, procedures, and practices—concentrates on specific procedures. An individual Focus Survey requires 4-6 hours of onsite observation of a specific facility, whereas a Full Survey requires two days and is usually completed by three Surveyors.
