BERKLEY VOTES TO EXPAND CLEAN ENERGY ---Package Will Increase Renewable Power, Up Gas Mileage Standards

Dear Tony,

On Thursday, I voted for The Energy Independence and Security Act. The landmark energy package, which passed on a vote of 235 to 181, will increase renewable energy development, strengthen gas mileage standards, address greenhouse gas emissions and decrease dependence on foreign oil. The legislation repeals billions of dollars in taxpayer giveaways to big oil and gas companies and is free of subsidies for the nuclear power industry.*1

�Creating more clean energy is good for families, good for our economy and good for our environment. Investing in solar and other renewable power resources will increase America�s energy independence, while creating more jobs and new businesses. This legislation also repeals billions in taxpayer giveaways to big oil and gas and invests these dollars in the development of solar, geothermal and wind energy, which are free of greenhouse gas emissions,� said Berkley.

�I am very pleased that we are not spending a single dime in this bill to subsidize new nuclear power plants. Unlike nuclear power, renewable energy does not create toxic high level waste with no safe means of disposal. Subsidizing the construction of new nuclear reactors will only increase the pressure to dump toxic radioactive waste at Yucca Mountain. These dollars are far better spent encouraging more renewable energy development,� said Berkley, who successfully fought to block any nuclear subsidies from being added to the energy bill.

In addition, the Democratic package increases gas mileage standards for the first time in decades, a move that will mean more fuel efficient cars and trucks for Nevada drivers who stand to see a savings at the gas pump.

�Strengthening gas mileage standards will translate into savings at the gas pump for consumers who will be able to drive more fuel efficient cars. Using less oil will help break America�s dependence on Saudi Arabia and on nations that are hostile toward the U.S. and our allies,� said Berkley.

The Energy Independence and Security Act:

Increases the efficiency of vehicles to 35 miles per gallon by 2020;
Requires for the first time that 15% of our electricity come from renewable sources;
Improves energy efficiency of a wide range of products, appliances, lighting and buildings;
Makes an historic commitment to American-grown biofuels;
Invests in clean renewable and alternative energy tax incentives to build viable markets and create jobs.
While Nevada already has its own law requiring green energy use, Berkley noted that the legislation passed by the House today would create a national renewable electricity standard (RES) for the first time. A strong advocate for green energy development in Nevada and nationwide, Berkley has consistently supported legislation in Congress that utilizes the same concept as Nevada�s renewable portfolio standard (RPS) law.

�Passage of a renewable electricity standard will encourage the production of more solar, wind and geothermal power and help move America toward real energy independence. As we have seen in Nevada, having such a requirement in place will promote the development of new clean energy sources for families, while also protecting our environment and addressing climate change,� said Berkley, referring to the requirement in Nevada law that 20% of energy consumed in the Silver State be drawn from renewable sources by 2015.

Berkley pushed for inclusion of a nationwide RES as part of a comprehensive energy bill authored and passed by House Democrats earlier this year. President Bush has repeatedly threatened to veto legislation establishing such a mandatory renewable requirement. Berkley and fellow Democrats in Congress are preparing to stand their ground and challenge the President and his supporters on the clean energy issue.

�The State of Nevada has been a leader on this issue and we can look to the Silver State as an example of what should be done on a nationwide scale when it comes to a renewable energy requirement. The sun and wind are not owned by nations hostile to the U.S. and renewable energy does not create toxic radioactive waste or increase pressure for this nuclear garbage to be dumped in Nevada. The need for clean energy is not a partisan issue and I hope that those who support renewable power will join me in calling on the White House not to block passage of an RES in Congress,� said Berkley.*2

About U. S. Congresswoman Shelley Berkley:

Shelley Berkley was first elected to the U. S. House of Representatives in November, 1998. She won the election continuously every two years. Shelley represents constituents living in the First Congressional District of Nevada, including residents of Las Vegas, North Las Vegas, and unincorporated areas in Clark County. The District annually records the largest population increase in the nation. U. S. Congresswoman Shelley Berkley has A Lifetime of Commitment to Nevada.
She has lived in Las Vegas for over four decades. Shelley has a deep sense of commitment to give back to the community that opened the doors of opportunity for her. She also has never forgotten that her family headed west seeking a better life, and found it in Las Vegas. She completed junior high and high school in Las Vegas, then went on to become the first member of her family to attend college when she enrolled in UNLV. Elected Student Body President, 1971-1972, she graduated with honors and a B.A. in Political Science from UNLV in 1972. After earning her law degree at the University of San Diego School of Law in 1976, she returned to Las Vegas to begin her career.
U. S. Congresswoman Shelley Berkley has successfully sought appointments that enable her to meet the needs of Southern Nevada, since she swore in as a Member of Congress on January 6, 1999.
Shelley is a former Vice Chair of the Nevada University and Community College System Board of Regents. Appointed to the Board in 1990 by the Governor, she was then twice elected as a Regent by Las Vegas-area voters. She completed her second term on the Board in 1998. Throughout her tenure, Shelley worked to keep higher education in Nevada affordable and accessible to all qualified students.
This bright lady has devoted her energies to charitable and civic efforts ever since she was a teenager. Her work and ideas have contributed to many of Southern Nevada�s successes.
On February 23, 2004, U. S. Congresswoman Shelley Berkley wrote Dr. and Mrs. Tony Lei that, "Thank you for your generous contribution to my re-election campaign. I greatly appreciate your support. Once again the Department of Energy (DOE) is attempting to mislead the people of Nevada on the issue of Yucca Mountain. For nearly three decades, the DOE has been trying to convince the people of Nevada that our state is the prime spot to become the nation�s nuclear dumping ground. They are dead wrong.*1

Nevadans are already well aware of the dangers associated with transporting 77,000 tons of nuclear waste across the country on the nation�s highways and rail lines, through America�s cities and towns. Further, the DOE has fallen short on proving that storing the waste inside Yucca Mountain would actually be safe.

Monday, at a public hearing in Las Vegas, I entered a statement in the record expressing my many concerns about the proposed Yucca Mountain nuclear waste dump. Among my concerns is the DOE�s blatant disregard for the public�s apprehension over this project. The National Environmental Policy Act was set up to disclose the environmental impacts of major federal projects so that the public has a chance to review and comment. While the Energy Department has given us little reason to believe so, I am hopeful that it will make every effort to review each comment submitted by concerned Nevadans and provide an explanation of how they considered each suggestion or concern.

On Wednesday, there will be a hearing on the State of Nevada�s challenge to the DOE�s certification of the Licensing Support Network (LSN). The LSN is a database of documents that must be made available to the public. This database must be certified at least 6 months before the license application for Yucca is submitted. Without a license, the dump can never be built. From what I can see, it is clear that the LSN will not meet the requirements necessary to be certified because key documents are missing or incomplete. If the judge presiding over Wednesday's hearing agrees, Nevada wins and the DOE will not be able to meet its self-imposed deadline of June 30, 2008.

A live webcast of the proceeding will be available at www.cox96.net. The hearing is scheduled to begin in Las Vegas on Dec. 5 at 9 a.m. PST and continue until approximately 1 p.m. PST.

I have spent my entire career in the United States Senate opposing the nuclear waste repository in Nevada. After decades of substandard science, quality assurance failures, and a process rigged against the state of Nevada, it is no surprise that the nation is turning its back on this project. I will continue to leverage my position as Majority Leader in the Senate to ensure the dump is never built. It is time that the DOE end its failed pursuit of Yucca Mountain so that we can move on to resolving the underlying problem of what to do with our country�s nuclear waste.*2

Since Nevadans elected him to the Senate in 1986, Harry Reid has developed a reputation as a consensus builder and a skillful legislator. Even his Republican colleagues praise his reasoned, balanced approach.

The festivities will now take place in the State Library & Archives Building at 100 N. Stewart Street , on the Corner of Stewart and Musser.

The official lighting ceremonies for the Silver and Snowflakes Holiday Tree and for the Menorah will take place this Thursday, December 6th. The Carson City 5th Grade Music Students Singing Ensemble will lead the festivities with holiday music. Santa will also be in attendance to pass out candy canes.

About Governor James A. Gibbons:

Nevada Governor Jim Gibbons earned a B.S. in Geology and later, a M.S. in Mining/Geology from the University of Nevada at Reno. Gibbons received the MacKay School of Mines Alumnus of the Year Award in 1999, and remains an active supporter of Nevada��s university and community college system. He also earned his J.D. from Southwestern University School of Law and completed his post-graduate work at the University of Southern California. Born and raised in Sparks, Nevada, Governor Jim Gibbons was a former United States Congressman. Jim was first elected to represent Nevada's 2nd District in the House of Representatives in 1996. He was re-elected to a fifth term in November 2004. Prior to coming to Congress, Gibbons gained a distinguished military background. A former combat pilot and decorated veteran of both the Vietnam and Persian Gulf Wars, Governor Gibbons served in the United States Air Force from 1967 to 1971 and graduated from the USAF Air Command and Staff College as well as the Air War College. Attaining the rank of Colonel, Gibbons joined the Nevada Air Guard in 1975, and served as the group's Vice Commander from 1990 through 1996. Jim Gibbons served three terms in the Nevada State Legislature and was named ���Outstanding Freshman Legislator��?his first year in 1988. By 1993, Gibbons rose through the ranks to become Republican Whip of the State Assembly. Jim Gibbons is Governor of Nevada starting from January 1, 2007.
